The website www.cuboimages.it is a brand of Reda&Co Srl, based at Via Egidio Folli 25 – 20134 Milano – ITALY.
The present General Conditions concern the purchase of the photographic material belonging to Reda&Co Srl and archived in its web storage.
All purchase operations will be regulated by the provisions as in Direttiva Europea n.97/7 CE e il D. Lgs. N.185/99 e Leggi correlate e succ. Mod. (D.Lgs. 206/2005) on the protection of consumers in respect of “distance contracts”.
The distance contract concerns goods and products and is stipulated between the supplier Reda&Co Srl, based at Via Egidio Folli 25 – 20134 Milano and a costumer as part of a system of distance selling which employs the Internet as a communication technology.
Contracts will be concluded through direct access by the consumer to the corresponding website at www.cuboimages.it where, following the indicated procedures, it will conclude the contract for the purchase of the property. The online contract signed between REDA&CO Srl and the buyer is concluded with the acceptance of the order, even partial, by REDA & CO Srl.
Customers, by sending online the confirmation of their purchase order, unconditionally accept and commit themselves to comply, in their relationship with Reda&Co Srl, hereinafter referred to as Cuboimages, with the general and payment conditions contained in the following, they state that they have read and that they accept all the information provided in compliance with the above-mentioned regulations, also acknowledging that Cuboimages does not consider itself to be bound by other conditions unless previously agreed in writing.
Any total or partial nullity or invalidity of one or more articles of the present General Conditions will not affect the validity of the other articles contained in the contract, which are to be considered unlimitedly valid and effective. Instead of the invalid or ineffective condition another provision will be applied, which is suitable for the economic purposes of the agreement.
The present General Conditions of Sale must be examined online by Customers who visit the website www.cuboimages.it before they confirm their purchases. The sending of the order confirmation implies the complete knowledge of said General Conditions of Sale and their acceptance.
Customers commit themselves, once the online purchase procedure has been completed, to print and save the present General Conditions of Sale, already read and accepted during the purchase process.
The purchaser is prohibited to enter false and invented data in the registration online for the execution of the contract and related communications. The data details and e-mail address must match exclusively to its real and personal.
CuboImages is not responsible for any moral and/or economic effects resulting from improper use of the images or the information contained in them, especially for defamatory, pornographic uses which violate the privacy of the photographed people. The Customer raises CuboImages from any moral or economic consequences resulting from improper use of the photo as detailed above.
www.cuboimages.it is the CuboImages official portal. The purchase of the photographs is carried out by the Customer at the price stated, to be confirmed upon sending of the order confirmation.
The Customer can visit the website www.cuboimages.it and use the search form to find the images he/she is looking for. Then he/she can select the photographs he/she wants to buy and puts them in the cart. Once the choice has ended he/she has to fill in the order form with the personal data and then choose the way he/she wants to pay.
Before confirming the purchase to the Customer, the unit cost of each photograph chosen, the total cost in case of purchase of several photographs, will be recapitulated.
Every photograph has a price clearly indicated by clicking the image to enlarge it. Every photograph has different prices determinate from the resolution (high or low) and the use (commercial or personal) of the Customer.
Furthermore, the price of each photograph can be VAT included, the amount of which varies depending on the country of origin of the consumer: for example the price of a photograph sold to an Italian customer includes 22% VAT, whilst a Customer outside Europe will pay the same image without VAT because it is not provided by the legislation of his/her country.
VAT application is determinate in accordance with the italian law ART.7 DPR 633/1972.
By confirming the purchase, at the end of the transaction, the Customer will receive an email containing the details of the order (date, order number, description and resolution of the photographs, the total amount of the order), the related invoice as well as the download links of the purchased photographs.
The links for downloading the purchased photographs are available for a limited period of time. After this period of time the Customer will no longer have the option to download the image(s) directly purchased and will have to write to email@example.com to ask for the re-sending of the purchased image(s).
All the images sold by CuboImages e-commerce are CuboImages property and are covered by a non-exclusive and unlimited license to use, both for digital and printed use. Every purchased photograph is for the exclusive use of the Customer who made the purchase and can not be used by third parties that do not have purchased the product.
The payment for the photographs is to be made by the Customer upon sending of the order confirmation by using one of the payment methods indicated on the website: a Paypal account or a credit card.
Credit cards of VISA, VISA ELECTRON, MAESTRO, MASTERCARD, prepaid card PAYPAL, DISCOVER, AMERICAN EXPRESS, CARTA AURA circuits are accepted.
The transaction occurs online by means of the Secure E-commerce (3Dsecure) system and no information related to the credit cards is transferred to CuboImages. The data related to the order are transmitted encrypted according to the SSL (Secure Socket Layer) protocol directly to the servers of the payment provider service certified for the PCI DSS standard, which guarantees the security of data transmission according to the regulations in force. A warranty will be applied to any photograph that may have flaws that cannot be found at the moment of purchase, provided that the photograph is used correctly and with due care, that is to say, respecting its intended use and what is provided in the related technical documents, in compliance with the various operational regulations stated therein.
On the other hand, said warranty will not be applied in case of negligence and carelessness in the use of the photograph. The warranty is personal, therefore only the original purchaser can avail himself/herself of it.
Any flaw of the photographs must be communicated to CuboImages.
CuboImages reserves the right to check the actual presence of the fault found by the Customer and to replace the photograph only after such control.
The right of withdrawal for the purchases carried out on the website www.cuboimages.it is regulated by article 5 of Legislative Decree no. 185/99, according to which Customers have the right to withdraw unilaterally from the contract within 10 (ten) days from the date of purchase.
The moment of collection of the photographs coincides with the beginning of the actual execution of the related services, therefore the Customer, pursuant to the mentioned article 5 (paragraph 3), cannot exercise the right of withdrawal even though from the date of purchase to the moment of collection of the photographs fewer days have passed than the ten days provided by the decree.

The refund request must contain the banking details for the repayment of the amount paid, enclosing the confirmation voucher received at the moment of purchase. Cuboimages will not be liable for any direct or indirect damage.
The present contract is regulated by the Italian law. Any dispute that may arise concerning the validity, interpretation or execution of this contract shall be subject to the jurisdiction of the Court of Milano.
